Terms of Service

1. Who we are
TrackWizard (“TrackWizard”, “we”, “us”) is a mix-analysis service operated by Swander LLC, a company registered in Wyoming, USA. You can reach us at contact@swander.fr. By creating an account or using the service, you agree to these Terms.
2. What TrackWizard does
TrackWizard analyzes an audio file you upload and returns a deterministic technical read of your mix — loudness, spectral balance, stereo image, dynamics, and related measurements — compared against reference material for the genre you select. The output is informational guidance for producers. It is not professional mixing or mastering, financial, or legal advice, and it does not guarantee any commercial or artistic result. You remain the sole judge of your music.
3. Your account
Accounts use a passwordless email sign-in link. You are responsible for keeping access to your email inbox secure. One account is for one person; do not share sign-in links. You must be old enough to form a binding contract in your country (and at least 16).
4. Acceptable use
You agree not to:
- upload audio you do not have the rights to analyze;
- overload, probe, or attempt to bypass the service’s technical limits, rate limits, or access controls;
- reverse-engineer, scrape, resell, or build a competing product from the service, its analyses, its reference data, or its methodology;
- use the service for anything unlawful, or to infringe anyone’s rights.
We may suspend or close accounts that break these rules or put the service at risk.
5. Your content
You keep all rights to the audio you upload. You grant us a limited, temporary license to process your file solely to produce your analysis. We do not keep your audio: uploaded files are processed transiently and deleted after the analysis completes. We retain only the resulting numeric diagnostic and basic run metadata (see our Privacy Policy).
6. Beta
TrackWizard is offered during a beta. It is provided “as is”: features may change, break, or be removed, and some capabilities (such as stem-separation “pass 2”) are available by invitation only. We may change the scope of free and paid features over time.
7. Payment
Core analysis (“pass 1”) is currently free with an account. If we introduce paid plans or credits, the price, billing cycle, and what they include will be shown before you pay, and any purchase will be subject to the terms presented at checkout.
8. Availability & changes
We aim for a reliable service but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue any part of the service, and we may update these Terms; material changes will be reflected by the “last updated” date, and continued use means you accept them.
9. Disclaimer & limitation of liability
To the fullest extent permitted by law, the service is provided without warranties of any kind, and we are not liable for indirect, incidental, or consequential damages, or for any loss arising from decisions you make based on an analysis. Nothing in these Terms limits rights that cannot be limited under the mandatory consumer law that applies to you.
10. Termination
You can stop using the service and ask us to delete your account at any time (contact@swander.fr). We may terminate access if you breach these Terms.
11. Governing law
These Terms are governed by the laws of the State of Wyoming, USA, without prejudice to the mandatory consumer-protection rights you may have in your country of residence.
